Joint Enterprise (Significant Contribution) Bill

Amend the Accessories and Abettors Act 1861 to provide that only a person who directly commits, or who makes a significant contribution to the commission of, an offence may be held criminally liable.

BE IT ENACTED by the King’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Joint enterprise: criminal complicity

(1) The Accessories and Abettors Act 1861 is amended as follows.

(2) In section 8 (abettors in misdemeanors), after “shall” insert “, by making a significant contribution to its commission,”.

2 Extent, commencement and short title

(1) This Act extends to England and Wales and Northern Ireland.

(2) This Act comes into force at the end of the period of 90 days beginning with the day on which it is passed.

(3) This Act may be cited as the Joint Enterprise (Significant Contribution) Act 2024.

The Bill will have its second reading Friday 2nd February 2024.
